1. Agreement to Terms

These Terms of Service govern your use of the Modal Unity website, modalunity.com, and any purchase made through it. The website is operated by KJ Ecom, a company registered in the Netherlands.

By accessing or using the website you agree to be bound by these Terms and our related policies, including our Privacy Policy, Shipping Policy, Return and Refund Policy and Payment Policy.

If you do not agree with these Terms, please do not use the website.

By placing an order you confirm that you are at least 18 years old, or the legal age of majority where you live, or that you have the consent of a parent or guardian.

2. Use of the Website

You agree to use the website only for lawful purposes. You must not:

• Break any applicable law or regulation
• Interfere with the security, performance or functionality of the website
• Upload malicious code, viruses or harmful content
• Use the website for fraudulent, abusive or unauthorised activity
• Copy or scrape the website’s content or product data for commercial use

We may restrict or terminate access if we reasonably suspect misuse.

3. Intellectual Property

All content on the website – text, product photography, customer imagery, branding, graphics, logos and design – is owned by or licensed to KJ Ecom and protected by intellectual property law.

You may not reproduce, distribute, modify or use any content from the website without our prior written permission.

4. Product Information & Availability

We work to present accurate descriptions, measurements, images and prices. Please note:

• Availability may change without notice
• Colours may vary depending on your device and screen settings
• Size guides and fit notes are provided as guidance and are not a guarantee of fit
• Where a product’s fibre composition is stated, it reflects the information supplied to us by the manufacturer

We may limit quantities or discontinue products at any time.

5. Orders & Payment

Placing an order is an offer to buy. The contract is formed when we send your shipping confirmation.

We may accept, decline or cancel an order for reasons including:

• Payment authorisation problems
• Suspected fraud or misuse
• Pricing or technical errors
• Product availability

If we cancel an order after payment has been taken, we refund it in full. Payments are processed securely through Shopify and its payment partners as described in our Payment Policy. You agree to provide accurate and complete billing and delivery information.

6. Pricing & Errors

Prices are shown in the currency of your selected market and include VAT where applicable. Prices may change without notice; changes do not affect orders already confirmed.

Occasionally an error in a price, description or availability occurs. We may correct such errors and cancel or adjust affected orders. Where this affects an order you have placed, we will contact you before proceeding and you may cancel for a full refund.

Automatic quantity discounts and promotional codes apply as shown at checkout. Discounts of the same type do not combine unless stated.

7. Shipping & Delivery

Delivery is free on every order. Estimated delivery times are provided for guidance and are not guaranteed. Delays may occur due to:

• Carrier disruptions
• Customs processing
• Weather conditions
• Operational delays or high shipping volumes

You are responsible for providing an accurate delivery address. Full details, including duties and taxes for deliveries outside the EU and UK, are in our Shipping Policy. Risk in the goods passes to you on delivery.

8. Returns, Refunds & Cancellations

Returns and refunds are handled under our Return and Refund Policy. Key points:

• Consumers in the EU and UK have a legal right to cancel within 14 days of delivery for a full refund
• We accept returns for any reason up to 30 days from delivery; from day 15 to day 30 refunds are issued as store credit
• In most cases we offer a keep-it option – a partial refund or store credit with no return required
• Orders may be cancelled within 24 hours of purchase
• Returned items must meet the eligibility requirements in the policy

Please read the full policy. Nothing in these Terms affects your statutory rights as a consumer, including rights in relation to goods that are faulty or not as described.

9. Accounts & User Responsibility

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Tell us at once if you believe your account has been used without permission.

10. Third-Party Services

The website may link to or use third-party services, tools or websites, including payment providers, carriers and social platforms. We do not control these and are not responsible for their content, policies or practices.

11. User Feedback & Submissions

Feedback, suggestions, reviews, photos or other submissions you provide may be used, edited and published by Modal Unity without restriction or compensation. You confirm that your submissions are your own, are lawful and do not infringe any third-party rights. We may remove submissions at our discretion.

12. Disclaimer of Warranties

The website is provided “as is” and “as available”. We do not guarantee that it will operate uninterrupted, securely or free of error.

To the fullest extent permitted by law we disclaim all warranties, express or implied, relating to the website. This does not affect the legal guarantees that apply to the products you buy, or your statutory rights as a consumer.

13. Limitation of Liability

To the extent permitted by law, KJ Ecom is not liable for indirect, incidental or consequential loss arising from your use of the website or products purchased through it.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law, including your statutory rights as a consumer.

14. Indemnification

You agree to indemnify and hold harmless KJ Ecom, its affiliates, employees and partners from any claim, damage or expense arising from:

• Your breach of these Terms
• Your misuse of the website
• Your violation of applicable law or third-party rights

15. Termination

We may suspend or terminate access to the website at any time if we reasonably believe these Terms have been breached. Termination does not affect orders already placed or rights already accrued.

16. Governing Law

These Terms are governed by the laws of the Netherlands. If you are a consumer, you also benefit from the mandatory consumer protections of the country where you live, and nothing in these Terms removes those rights. Where the law of your country allows, you may bring proceedings in the courts of your place of residence. Consumers in the EU may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

17. Changes to These Terms

We may update these Terms from time to time. Changes are posted on this page and apply from the date they are published. Continued use of the website after a change means you accept the revised Terms.
